A velha fantasia de que rede social, grupo de WhatsApp e assembleia sindical viraram terra sem lei sofreu mais um duro choque de realidade em Itabuna. Em sentença contundente, a Justiça condenou o Investigador da Polícia Civil Jadilson de Jesus Ferreira ao pagamento de R$ 10 mil por danos morais ao servidor Roberto José da Silva, além da obrigação de gravar um vídeo público de retratação reconhecendo a falsidade das acusações feitas contra ele.
O caso escancarou algo cada vez mais comum: gente que confunde crítica política ou sindical com licença para atacar honra alheia. Segundo a decisão judicial, o réu ultrapassou completamente os limites do debate legítimo ao acusar Roberto José, sem provas, de práticas ilícitas, chamando-o inclusive de “parasita” e afirmando que o Conselho Fiscal do sindicato seria “viciado”. Para o magistrado, houve clara violação à honra e à imagem do autor, especialmente porque as ofensas foram espalhadas em grupos de WhatsApp com grande alcance entre policiais civis.
E aqui entra um detalhe que desmonta muito “valentão de internet”: o réu sequer compareceu à audiência. A ausência levou à decretação de revelia, fortalecendo a presunção de veracidade das acusações apresentadas por Roberto José. Enquanto testemunhas confirmaram os ataques públicos e a circulação dos vídeos ofensivos, a defesa do acusado ficou restrita ao velho discurso genérico da “liberdade de expressão”. O juiz foi direto: liberdade de expressão não é salvo-conduto para difamação, ataque pessoal e acusação irresponsável.
A sentença ainda traz um componente simbólico e pedagógico que certamente incomodará mais do que o bolso. Além da indenização, Jadilson foi condenado a produzir um vídeo de retratação afirmando a inveracidade das declarações ofensivas e divulgar exatamente nos mesmos grupos onde espalhou os ataques. Ou seja: a mesma vitrine usada para tentar destruir reputações agora deverá servir para desmentir publicamente as acusações. Caso descumpra a ordem, poderá pagar multa diária de R$ 200, limitada a R$ 10 mil.
A decisão deixa um recado cristalino para os profissionais da difamação militante, tão comuns em ambientes políticos e sindicais: coragem de gravar vídeo acusando é fácil; difícil é sustentar a acusação diante de provas, testemunhas e de um juiz. No fim, o discurso inflamado terminou transformado em condenação judicial, indenização financeira e humilhante obrigação pública de pedir desculpas. Porque opinião é direito! Injúnia travestida de militância, não!
